These general terms and conditions for the provision of services (and sales, where applicable) apply, without restriction or reservation, to all transactions carried out on one of the websites mentioned below:

Service provider


The websites are managed by Marketing Bienveillant represented by Monique Michel


Article 2 – Price – Terms of payment


The prices are in euros and are either established by type of service, or on a personalized estimate. The price of the services is confirmed on the page of the service offer, either via confirmation e-mail and is validated by the customer's registration.


In the same way, the terms of payment (for the service, for the order) vary according to the services offered.


For online consultations, payment is made when making an appointment and before the start of these. 


The bank details of Marketing Bienveillant are specified on the site. Payments are made via PayPal, credit cards, bank transfer or SEPA.


For Skype, Zoom or online training sessions: the services are delivered electronically via access to the members area or other agreed between Marketing Bienveillant and the client. Face-to-face consultations can be paid for at the time of delivery, in cash or by electronic means of payment. 
Payments are made at the time of purchase of the service, and processed via the secure platform PayPal, Stripe or WIX Payments. 

Payments by bank transfer are accepted according to the conditions of your purchase invoice. Payments by check are not accepted. 

Unless otherwise agreed by us, all our invoices are payable by bank transfer in cash and at the latest within fifteen calendar days from the invoice date mentioned on the documents. Except discount.

In the event of non-payment of an invoice on the due date, we are entitled to suspend any service or supply, without further action or warning.


Article 3 - Complaints


Any complaint and/or dispute by the customer against the service must be formulated and justified, by e-mail to the address moniquemichel@marketingbienveillant.com  no later than 48 hours from their generating event, under penalty of forfeiture.


Article 4 – Conditions of withdrawal and reimbursement


If necessary, the customer has a period of 7 working days following his registration to exercise his right of withdrawal provided that he is registered no later than 9 days in advance. All he has to do is send an email to moniquemichel@marketingbienveillant.com requesting a refund. 


If no refund guarantee is mentioned on the sales page, no refund is made after access to the member area for the service ordered.


For information, the regulations exclude from the legal withdrawal period the “supply of audio or video recordings, or computer software when they have been unsealed by the consumer”. The money-back guarantee is therefore not a legal obligation.


In any case, the refund guarantee does not apply to work already carried out on the sites, preparation, creation and the same applies to coaching and support sessions, workshops, except in the case where the sessions/workshops/trainings did not take place. Administrative costs are to be deducted.

By requesting a refund, you permanently lose access to the training or service.

Article 5 – Terms of use

Workshops and Conferences
The services are provided under the conditions described on the site concerning the conference/workshop/training. Participants receive a confirmation email at the address provided during registration with, if applicable, a link to access the member area and the materials and tools.


All registrations are valid by name per person or per company. Sharing of content with third parties and/or resale is prohibited.
It is permitted to download the content for personal use, and to use the cited tools and templates for commercial purposes, if permission is explicitly granted in the content.

Coaching & Support & Consultancy & Training
Coaching, consultancy, support and training sessions are delivered by Skype, Zoom or face to face, depending on what is mentioned on the presentation page. Appointments are scheduled when making appointments online or during an email exchange with the customer following their order/registration. 
Appointments are fixed at a date and time agreed in advance between the client and the service provider (team). In the event of a major impediment,   both parties may postpone the meeting to a later date, subject to indicating this more than 48 hours before the initial meeting. In the event of the client's absence or if the client cancels an appointment less than 48 hours in advance,  la consultation will remain due.
If the service provider encounters a personal impediment, he undertakes to contact the client as soon as possible to schedule a new appointment at the client's convenience. Coaching or other services by Skype or Zoom appointment are deducted from the exact time of the appointment, even if the client is late. The service provider undertakes to keep confidential the information provided by the client concerning its activity, unless otherwise agreed with the client.

Article 6 - Liability


Benevolent Marketing is committed to giving the best of itself (guarantee of means and not of results). 
Customers acknowledge and accept that the proposed approaches are used under their sole responsibility, at the expense of Marketing Bienveillant. 
Marketing Benevolent cannot under any circumstances be held responsible for direct or indirect damages - including operating loss, loss of profit, damages or costs - which could result from the application of the skills acquired in workshops, training courses and others.
Furthermore, it is the client's responsibility to ensure that the application of the recommended strategies complies with the regulatory and legal provisions of its jurisdiction. Under no circumstances can the content offered be considered as legal or accounting advice.
Marketing Benevolent, cannot in any event, see its responsibility or that of its partners engaged.


Article 7  - Intellectual Property


By making an online reservation, the customer will receive the agreed service from Marketing Bienveillant. He will be asked not to take a photo, record, use or distribute selfies with all or part of the equipment provided.


Any reproduction or representation, in whole or in part, for other purposes, in particular commercial, on any medium whatsoever is prohibited. Failure to comply with this prohibition constitutes an infringement which may engage the civil and criminal liability of the counterfeiter.


The material provided is protected by copyright and general intellectual property legislation. No mention or use of trademarks, trade names, acronyms, logos, drawings or photos appearing on the Site may be made without our prior written consent. Any reproduction or use not previously and expressly authorized constitutes the offense of counterfeiting and is liable to civil and criminal prosecution. In addition, uses contrary to morality and morality cannot be subject to any authorization.

Article 8 – Privacy


We respect your privacy. We do not collect data without customer consent. Personal data is kept confidential and is neither transferred nor sold to third parties. All emails sent contain a link that allows you to no longer receive correspondence.

Article 9 – Invalidity – Force majeure – Applicable law and competent court


If for any reason a provision of these general conditions should be declared inapplicable, this inapplicability will not affect the application of the other provisions of the general conditions. The one deemed inapplicable is then replaced by the closest possible provision.


Marketing Bienveillant cannot be held responsible for any non-performance resulting from a case of force majeure, beyond its control, including in particular, without limitation, cases of war, riot, insurrection, interruption transportation, import or export problems, strikes, lockouts, shortages, fires, earthquakes, storms, floods.
